Off market sales are not our default approach. In the vast majority of cases, full exposure to the open market produces the strongest and most defensible outcome for the estate. In limited situations, an off market sale may make sense, but only when it is specifically requested by the client and after the client has been fully informed of the advantages and disadvantages of each available option. When an off market sale is pursued, the executor benefits significantly from having professional real estate representation to ensure proper valuation, contract protections, and risk management.
How do you help protect executors from future disputes or claims
